Contract Disputes

Hiller Law brings extensive experience to the review and analysis of contract-based disputes in a multitude of industries and contexts. This includes commercial, service, manufacturing, licensing, development, distribution, joint venture, asset purchase, real estate, lease, and employment agreements.

Business Torts
Some business disputes involve intentional misconduct and other unlawful business acts. Damages in these situations can include more than simple monetary loss, and can inflict harm to a company's reputation and good will or to its competitive advantage and future business prospects. Mr. Hiller has handled a wide variety of cases involving business misconduct that take many forms, including claims for fraud and misrepresentation, defamation, unfair and deceptive business practices, unfair competition, breach of fiduciary duty, and unjustified interference with contracts and business relations.

Construction Law and Litigation
Hiller Law has experience representing owners, general contractors, architects, engineers, subcontractors, material manufacturers and suppliers in disputes arising out of the design or construction of a variety of projects from large public and private commercial projects to residences. Mr. Hiller can handle a variety of complex construction litigation matters involving design and performance defects; remediation issues; delay and disruption claims; mechanics lien claims; surety issues; and payment bond claims, including both federal Miller Act and "little Miller Act" state claims.

Controversies Between Business Competitors
Hiller Law draws upon a broad range of experience representing businesses in a varied array of complex commercial issues. Oftentimes these cases center on controversies between business competitors. Mr. Hiller has litigated numerous cases in various state and federal courts involving claims about unfair competition, antitrust, non-compete and non-disclosure agreements, trademark and copyright infringement, commercial disparagement, and false advertising, among others.

Corporate Governance Disputes
Mr. Hiller has represented clients in a wide variety of actions involving corporate governance. This includes internal company disputes, direct and derivative shareholder actions, challenges to board actions, questions about proper corporate governance, fiduciary responsibilities of directors and officers, and matters involving the interpretation or application of bylaws, operating agreements, and other corporate agreements.

Defense of Professional Malpractice Claims
Hiller Law has investigated, counseled, and defended malpractice claims against professional individuals, organizations and public entities. Mr. Hiller has defended professional malpractice claims in counties across North Carolina, including claims against design professionals, architects and engineers, real estate agents and professionals, financial planners, investment consultants, and medical/healthcare providers.

Government Investigations and White Collar Defense
Government or regulatory agency investigations can put a company's reputation and operations at risk. It is important at the first sign of suspected misconduct for a business, its board or audit committee to call upon counsel to assist with a thorough internal investigation. Mr. Hiller has experience representing clients in response to grand jury subpoenas, criminal investigations at the state and federal level, regulatory inquiries, and general internal investigations. He can work with your company to understand the scope of the issue, design an investigation strategy and then recommend a course of action or response.
